Please
read the following Terms and Conditions. If you
do not agree to all of these Terms and Conditions of use,
do not use this site! At the footer of this
page is a button allowing you to proceed to the signup
form.
Registration and Fees
- The purchaser, ("You") must be 18 years
of age or older and hold a current and valid United
Kingdom drivers licence in order to be eligible to
register as a member and use the Nichibo Japan Trading
autoSearch system.
- Registration can only be made and transactions are
only valid if a vehicle is to be delivered to a United
Kingdom address.
- Before you are able to place a bid or an offer on
a vehicle through the Nichibo Japan Trading Database,
You must pay to Nichibo Japan Trading a deposit of
¥100,000. You're deposit is deducted from
the F.O.B.
- You will receive notification that your deposit
has been received by Nichibo Japan Trading by email
or fax.
- In the event that You do not purchase a vehicle
via autoSearch within 60 days of Nichibo Japan Trading
receiving your deposit, the deposit will be refunded
to you.
Agents Fee
- Nichibo will charge and agents fee of ¥100,000 per unit for vehicles purchased under ¥2,000,000.
- The agents fee for vehicles over ¥2,000,000 is 5% of the purchase price.
Login Name and Password
- You must ensure that your User Name and Password
are kept strictly confidential.
- Nichibo Japan Trading will accept no responsibility
for the purchase of any vehicle that results from
You allowing a third party to use Your User Name and
Password.
- Any purchase that is made using Your User Name and
Password will form a binding contract between You
and Nichibo Japan Trading.
Payments
- When You have received notification that you have
successfully purchased a vehicle through Nichibo Japan
Trading, the full F.O.B amount shall be paid in cleared
funds to Nichibo Japan Trading within 7 days from
the Acceptance Date.
- All payments must be made my Telegraphic Transfer
(T.T).
- You will be notified by email when payments are
due.
Shipping
- Upon receipt of your full payment Nichibo will arrange the shipment of your purchase.
Non-payment
- If full payment is not made within 7 days from the,
Nichibo Japan Trading will refuse to export the vehicle
from Japan to U.K.
- Nichibo Japan Trading will re-auction the vehicle
in Japan and use the deposit paid towards the costs
of re-auction.
- Any money remaining from the sale of the vehicle
shall be refunded to You.
- In the event that the deposit does not cover the
costs of re-auction, then Nichibo Japan Trading may
take legal action against you to recover outstanding
costs resulting from non-payment.
Title
- You shall acquire possession of the vehicle on the
express condition that title to the vehicle shall
be retained by Nichibo Japan Trading and shall not
pass to you until the deposit, the Balance and
any additional costs you have accepted, have been
paid in full.
Your Bid
- The bid you submit through the Nichibo Japan Trading
autoSearch system will be the price in Japanese Yen
¥ currency you are offering to pay for the chosen
vehicle.
- Your bid EXCLUDES all shipping, customs, import,
VAT, compliance, on-road registration, Japanese documentation
and agent charges. However we do provide a simple
estimated landed cost calulator to give you an estimate
of what the shipping charges and VAT would be on the
vehicle if you are successful in purchasing it from
the auction house in Japan.
- If your bid is accepted, then a contract binding
you and Nichibo Japan Trading is formed in accordance
with the Terms and Conditions.
Acceptance of your bid
- To avoid any doubt, acceptance of your bid by Nichibo
Japan Trading is conditional upon:
- The vehicle being mechanically and structurally
sound or otherwise of "acceptable quality".
- The vehicle passing an odometer check and obtaining
independent odometer certification (an Odometer Certificate)
from Japan - www.jevic.co.jp
- Nichibo Japan Trading and/or any authorised agent
successfully obtaining the vehicle chosen by You from
its Japanese suppliers;
- The appropriate de-registration documents required
for exporting the vehicle from Japan to United Kingdom
being available;
- If, after appropriate inspection, Nichibo Japan
Trading does not believe that the vehicle satisfies
any one or more of the conditions set out above, then
your bid will not be accepted and you will be notified
of such non-acceptance.
Vehicle Compliance
- Once the vehicle arrives in United Kingdom, Nichibo
Japan Trading will transport the vehicle to a vehicle
compliance centre closest to the port at which the
vehicle arrives.
- Nichibo Japan Trading will ensure that the vehicle
is issued with a Vehicle Identification Number (VIN)
and otherwise complies with all legal requirements
for being driven on United Kingdom roads.
Additional Compliance Costs
- In addition to the FOB each vehicle is subject to
SVA and may also require a model report. Please refer
to the Model
Report list here >> or contact your preferred
service provider for more information.
- Your bid does not include any costs incurred in
converting left-hand drive vehicles, trucks, commercial
vehicles or vehicles used solely for competition purposes,
to United Kingdom compliance standards.
- If such conversion or any other costs are required,
You will be notified and a counter-Offer Price will
be offered to You by Nichibo Japan Trading in order
to make the vehicle compliant.
- You are entitled to accept or reject any counter-offer.
- Your bid does not include any SVA costs incurred.
Delivery
- Upon receipt of your Deposit, the Balance, any additional
costs accepted by You and once the vehicle has completed
all compliance procedures, Nichibo Japan Trading will
deliver the vehicle to You at a location specified
by You ("the Location").
- The Location must be within a 30 mile radius
from the vehicle compliance centre at which the vehicle
is issued with a Warrant of Fitness.
- If the Location is outside a 30 mile radius
from the vehicle compliance centre, then Nichibo Japan
Trading may charge a delivery fee in addition to the
Fee, Deposit and the Balance payments.
- Nichibo Japan Trading will advise You of any additional
charges before accepting the Offer Price as a counter-Offer
Price and you may accept or reject the counter-Offer
Price.
Risk
- The vehicle shall be and remain in all respects
at Your risk as from the time You receive delivery
of the vehicle.
Odometers
- Nichibo will in instruct JEVIC to conduct an independent odometer inspection to determine your purchases authenticity.
- It is Nichibo’s policy not to supply or export vehicles that fail the odometer inspection.
Disputes
- Particular Position: If a dispute or complaint arises
as to the application to the contract of any of the
provisions of:
Repairs and Faults
- If You consider that Nichibo Japan Trading has not
adequately or at all made good or repaired vehicle
defects which it is obliged to make good or repair,
You should first call upon Nichibo Japan Trading to
remedy the defects and give it reasonable time to
do so.
- If Nichibo Japan Trading does not then adequately
comply with its obligations, or if it is not practicable
when the defect is apparent to call upon Nichibo Japan
Trading to remedy the defects, You may have the defects
repaired or made good and recover the reasonable cost
from Nichibo Japan Trading - Provided always:
(a) that You give to Nichibo Japan Trading copies
of such worksheets, or other evidence, as it may reasonably
require; and
(b) that before undertaking such remedial work You
gave Nichibo Japan Trading written notice of Your
intention to do so, and give it a reasonable opportunity
to inspect the vehicle before work commences.
- If Nichibo Japan Trading fails or refuses either
to remedy the defects, or if You having fulfilled
all necessary requirements on your part, Nichibo Japan
Trading refuses to pay Your reasonable costs, you
may make application to the Motor Vehicle disputes
tribunal in the United Kingdom.
